Yes, this year has seen excessive activism of the Apex court, so much so that, its over activism created a suspicion if the other pillars of Democracy are in existence. I think, this is due to failure of the other pillars Executive and parliament.

I feel that we need to have a system where both pariliament and legal system work together and any rule made by the parliament gets vetoed by the supreme court , otherwise the ruling politicians will bring in laws to suit them like the haste in which they get their own salaries passed without even a debate, similarly their own tour and other expenditures which get passed without a murmur ! It is only now thanks to the media and also the intervention of Supreme court on many issues that they are made to think twice !

Last sentence said it all, relative inactivity of executive with policy paralysis and corruption is at its umpteenth peak lead to activism of Judiciary as I would not call it over acting, as the prime function of Judiciary is to see to protect Constitution of India, if not then government can become dictator.

No doubt it is inaction or I would call it dereliction of duties of the functionaries of each domain that creates situations for such highly desirable actions on the part of courts. About Supreme court I have to mix my gratitude towards it with a feeling of outrage over its recent decision criminalizing sexual behavior of adults. I was simply horrified. At best it could have held back the decision of the High court directing the Central government to remove the relevant article of the Constitution!!

Though this intervention is good, its adding more burden on the judiciary, which in turn upsets the main judiciary functioning.
The total effect emerges in to the shape of 'In convenience' to the people. This is not a healthy trend.

I agree with you, It was a major failing of the Supreme court ! I have a feeling that they were challenging the parliament since earlier when they spoke abt criminalisation of politics ,I remember all the Congress spokesperson making a noise and saying it is the duty of the parliament to bring in laws and Supreme court should stick to legal matters only !

Now, some pressures on apex court will be shared by independent Lokpal, which is now a law after honorable president of India's assent, recently, there is always a fine line between judicial activism and judicial vigilance, and about long rows of cases, as it is obvious there are some corruption are there and for this cases are going for long and it even goes for more than 30 years, only to benefit lawyers, reform is necessary.
